U.S. Appeals Court Temporarily Restores Trump's Tariffs

The U.S. Court of Appeals for the Federal Circuit has intervened in ongoing legal proceedings regarding President Trump's tariffs, granting a temporary administrative stay. This move reinstates the tariffs while the court reviews the administration's appeal.

Last Wednesday, the U.S. Court of International Trade rejected most of the tariff increases implemented by the President. The three judges presiding over the case argued that Trump overstepped his constitutional bounds by invoking a 1977 emergency law to impose "an unlimited tariff on goods from practically every country." The judges asserted that Congress, not the President, holds the primary authority in such matters.

Trade policy has been a contentious issue under Trump's administration, causing disruptions to global supply chains. In April, the President moved to impose high additional tariffs on several countries, subsequently reducing them to a 10% base rate for a 90-day period. Existing tariffs of 25% remain in effect for automobiles, along with steel and aluminum products. Negotiations with the European Union are ongoing, with potential tariffs of 50% scheduled to take effect on July 9 yet to be enforced.

The plaintiffs have been ordered to respond to the administration's motions for a stay by June 5, 2025. This temporary restoration of the tariffs is seen as a measured step allowing for continued consideration of the case before potentially reaching the Supreme Court.
