Growing Issues for Willingdon Heights Residents in Tardeo as BMC Insists on Building Parking Tower for Occupancy Certificate

In the bustling city of Mumbai, the residents of Willingdon Heights are hoping for a reprieve under the newly announced Occupancy Certificate (OC) policy. The high-rise building, located in the heart of Tardeo, has been facing challenges in obtaining an OC for its top 17 floors.

The building, which houses 62 flats and 49 parking spaces, has been using extra floor space index, according to the Brihanmumbai Municipal Corporation (BMC). This has led to the need for "sufficient parking space," as cited by the BMC, and the residents have been asked to build a parking tower to accommodate 40 cars as a prerequisite for the OC.

However, the residents have refused to build the parking tower due to the immense task and cost involved. They seek regularization as per the Development Control Regulations (DCR), 1991, instead of the 2034 regulations. The total charge towards regularization of the building is Rs 35 crore, but the residents do not need to pay this amount nor build the parking tower, according to their assertions, under the new policy.

The government has announced the new OC policy last week, but the member of the government who made the announcement is not explicitly named in the provided search results. The closest related minister mentioned in the context of new policies is Boris Pistorius, who spoke about military service modernization in Germany.

It is worth noting that a Rs 5 crore penalty has been levied on the residents for not complying with parking norms. This penalty, along with the charges and clauses towards regularization, currently remains.

Following a Bombay High Court order, residents of the top floors vacated their homes on August 27. The developer has given the deemed conveyance to the society and is responsible for all proceedings towards obtaining the OC. An adjacent open space, as per the map, can be used for constructing a parking tower.

If Willingdon Heights fulfils the clauses for the new OC policy, a concession can be granted. The residents of Willingdon Heights are eagerly awaiting this concession and the opportunity to finally call their homes their own.
