The Industry and Commerce Chamber (IHK) of Lower Saxony has issued a warning about increased strains from a municipal tax on single-use packaging following the Tübingen model. 94% of the respondents anticipate a higher administrative burden, such as diligently tracking packaging use. 86% believe the tax of 50 cents in Tübingen would lead to slumping sales, and 71% reckon they'd likely boost prices. The chamber's frustration is rooted in the prospect of each municipality devising its unique rules, leading to a disjointed assortment of regulations that could market chaos and undermine competition, Scherf explained. Businesses in packaging tax municipalities could find themselves at a disadvantage compared to those in other regions, with customers favoring tax-free locales fear asserts the chamber.
Following the Federal Constitutional Court's verdict on the Tübingen packaging tax, cities in Lower Saxony have shown interest in adopting a similar tax, according to a recent survey by the German Press Agency. Proposals can be found in Goettingen, Hildesheim, Cuxhaven, Emden, and even Hannover. Decisions remain to be finalized.
In Tübingen, the tax has been active since 2022. Businesses selling food and drinks there are expected to pay the packaging tax on non-reusable packaging and other items. Outlays of 50 cents are due for packaging like coffee cups and pizza boxes, while 20 cents are charged for single-use cutlery and straws. The city's goal is to lessen litter in public spaces.
A fast-food outlet proprietor lodged a complaint, but to no avail. The Federal Constitutional Court dismissed the complaint and deemed a packaging tax as constitutionally valid.
