Insolvency Troubles and Ongoing Investigations for Gensol Engineering and BluSmart Mobility

Insolvency petitions filed against Blusmart Mobility and Gensol Engineering, prompting official notices from the National Company Law Tribunal (NCLT)
In a recent turn of events, both electric vehicle ride-hailing service BluSmart Mobility and solar manufacturer Gensol Engineering are grappling with insolvency issues. On Tuesday, the National Company Law Tribunal (NCLT) issued notices to both firms over three fresh insolvency claims by financial creditors.
Spectrum Trimpex Pvt. Ltd. and Catalyst Trusteeship Ltd. submitted petitions against BluSmart over payment defaults amounting to Rs 1 crore each under Section 7 of the Insolvency and Bankruptcy Code (IBC). In a separate case, Equentia Financial Services Pvt. Ltd. accused Gensol of a loan default worth approximately Rs 9 crore. The NCLT's Ahmedabad bench, comprising Judicial Member Shammi Khan and Technical Member Sanjeev Kumar, has mandated both firms to respond within a week. It's important to note that the bench declined to admit Catalyst's plea due to ambiguity regarding certain documents.
An earlier insolvency plea lodged by the Indian Renewable Energy Development Agency (IREDA) against Gensol due to a loan default surpassing Rs 510 crore was postponed to June 11 by the tribunal. IREDA had previously requested the tribunal to expedite the appointment of an interim resolution professional to protect its assets and alleged that the directors had fled after an order by the Securities and Exchange Board of India (SEBI).
Assets Frozen and Ongoing Probe by MCA and SEBI
The NCLT also ordered the freezing and attachment of all bank accounts and lockers belonging to Gensol and its associated entities in light of ongoing investigations by the Ministry of Corporate Affairs (MCA) and SEBI.
It's worth recalling that back on 15 April, SEBI barred Gensol, its Managing Director (MD) Anmol Singh Jaggi and Whole Time Director Puneet Singh Jaggi from accessing the securities market due to governance lapses and fund diversions. On 12 May, all three individuals resigned from their positions.
Investigations Amidst Allegations of Financial Misconduct and Corporate Fraud
Gensol currently faces numerous allegations of financial misconduct and corporate fraud by the MCA. The MCA has been vigilant about the proceedings against Gensol, with claims of corporate fraud and financial misconduct. The MCA played a crucial role in having Gensol's assets frozen during NCLT proceedings. The MCA plans to wrap up its probe into Gensol within 3-5 months and has considered possible amendments to the Insolvency and Bankruptcy Code (IBC) for discussion during the upcoming monsoon session.
Unfortunately, specific details about the ongoing SEBI investigations into Gensol are not readily available. However, the decline in Gensol's share price by 94% in 2025 may be an indication of the impact these allegations have.
