Magadan port's primary operator, Rosmarport, penalized due to misuse of predominant market standing
The Magadan Regional Arbitration Court in Russia has upheld an administrative fine imposed on FSUE "Rosmorport" for violations of antimonopoly legislation. The decision, which was announced by the court's press service on August 14, 2025, follows a series of court rulings that confirmed the initial fine and a subsequent claim by FSUE "Rosmorport" to reduce the penalty.
The administrative fine was initially imposed due to FSUE "Rosmorport"'s alleged abuse of its dominant position in the Magadan port. Specific details regarding the violation that led to the fine have not been disclosed. The courts, however, have confirmed that FSUE "Rosmorport" set monopolistically high pilotage fee rates.
The case (No. А37-888/2024) was confirmed by courts of three instances, and FSUE "Rosmorport" sought to reduce the size of the administrative fine in court (case No. А37-13/2025). However, the Magadan Regional Arbitration Court has rejected this claim, and the court's recent ruling has not specified any changes to the size of the administrative fine.
FSUE "Rosmorport" may choose to appeal the current ruling to the appellate instance. It is important to note that the current ruling in case No. А37-13/2025 has not yet entered into legal force.
