Massachusetts regulators order DraftKings to pay a significant fine of $450k for improper credit card transactions

In a significant turn of events, the Massachusetts Gaming Commission (MGC) has issued a fine of $450,000 to DraftKings, the popular online sports betting platform. The fine is the largest ever issued by the MGC to a sportsbook operator, and it stems from violations related to the use of credit cards for gambling activities[1][2].

Between March 10, 2023, and February 13, 2024, DraftKings allowed deposits funded by credit cards, resulting in over 1,160 unlawful wagers totaling more than $83,000 placed by 218 customers through 242 credit card deposits[1][2][5]. The violations occurred due to a mix of internal miscommunications, a failed software fix, and the Pools product allowing for credit card wagers[1][2].

The MGC's rules prohibit gambling operators from accepting deposits or wagers made with credit cards within the state. This prohibition applies regardless of whether the deposit was made in Massachusetts or from outside the state using credit cards[1][2]. The Commission considers this restriction a "fundamental tenet" of the sports wagering law in the Commonwealth[2].

Following these breaches, the MGC ordered DraftKings to return the wagered funds made via credit cards to the affected players and conduct a third-party audit verifying no further credit card deposits or wagers were made on Massachusetts accounts during the relevant period[1].

It is worth noting that only a handful of states ban credit card deposits, with the goal of this restriction to prevent people from going into debt when funding their accounts[3]. DraftKings has since ceased accepting any other credit card payments[4].

DraftKings initially expressed confusion around the rules in Massachusetts regarding credit card gambling during a November hearing[2]. However, the company certified under perjury that it prohibits any use of credit cards for sports wagering on its Massachusetts platform, including deposits made from outside the state using credit cards[2].

This incident serves as a reminder of the importance of adhering to state regulations in the rapidly growing online gambling industry. The MGC's specific regulation forbids any use of credit cards for gambling deposits or wagers in Massachusetts, with no exceptions mentioned, and violations can lead to significant fines and corrective actions[1][2][5].
