There is a growing resistance in the southwestern state of Baden-Württemberg against the freshly implemented property tax, as reported by SWR. According to financial authorities in Stuttgart, nearly 30% of property owners in the region have lodged objections to the tax assessment since its enactment on January 1, 2025. This puts Baden-Württemberg in contention for the top spot nationwide in terms of the highest number of objections. Initially, over 1.4 million objections have been filed from a possible 4.8 million cases, as SWR reveals.

Constitutional Doubts

Approximately 1.3 million of these objections are categorized as mass objections, expressing concerns over the constitutionality of the new property tax law in Baden-Württemberg. In response to this high volume of objections, authorities have indicated that proceedings are currently on hold at the Federal Fiscal Court until ongoing court cases are concluded.

Mixed Results for Initial Lawsuits

Legal challenges against the new property tax have resulted in a mixed outcome thus far. In June 2024, the first two lawsuits making such claims were dismissed by the Finance Court of Baden-Württemberg. The plaintiffs from Stuttgart and Karlsruhe subsequently appealed to the Federal Fiscal Court.

Varied Tax Models Across Germany

It's worth noting that the property tax system varies across Germany. Most regions, such as North Rhine-Westphalia, adhere to a federal model, while others, like Baden-Württemberg and Bavaria, have developed their own tax models. In the latter state, the property tax is primarily calculated based on the land area and buildings. Bavaria currently has approximately 1.3 million objections, while North Rhine-Westphalia has 1.5 million objections.
