In the wake of a hefty fine slapped on several road construction companies by the mighty German Federal Cartel Office for their illegal collusion, the state and municipalities of Saxony-Anhalt are on high alert, sifting through possible damages claims. The region's transportation ministry is currently digging into the contracts these companies held, with the intention of considering any potential damage repercussions. A ministry representative confirmed that the upcoming meeting between the federal and state governments at the end of May will also touch upon this issue.

This scandal erupted when the Federal Cartel Office revealed on Tuesday that a slew of road construction companies across Germany were involved in a years-long, insidious web of illicit agreements regarding tenders for public authorities. Among the offenders was a company hailing from the town of Landsberg in Saalekreis. The collusion mainly affected tenders in various regions like Saxony, Saxony-Anhalt, Thuringia, Brandenburg, and Mecklenburg-Vorpommern between 2016 and 2019.

Rigged construction tenders across the nation

The companies were found to have conspiratorially passed numerous road repair and maintenance tenders from public authorities among themselves over an extended period. Andreas Mundt, the president of the Federal Cartel Office, had this to say, "Illegal cartel agreements can lead to exorbitant damages for public tenderers, which ultimately fall on the shoulders of citizens." The illicit deals afflicted a multitude of tenders and contracts from public tenderers such as municipalities and state transportation departments, impacting even simple road surface mending.

The Federal Cartel Office has since enforced fines totaling 10.5 million euros. Nevertheless, the affected municipalities and authorities still have the option to initiate legal action against the construction companies themselves. The Altmarkkreis Salzwedel, for one, confirmed they were examining the possibility of legal recourse. So far, no damages have been sought against a company implicated in the cartel agreement.

Ironically, the terms of the cartel agreement were anything but 'best in class'.
