Alcohol Control Bill: Senate Approves Significant Changes to Advertising Restrictions

The Alcohol Control Bill, a long-anticipated piece of legislation, has been approved by the Senate, marking a significant step towards easing advertising restrictions for alcoholic beverages while introducing new rules to prevent promotion targeting minors or encouraging excessive consumption.

Senator Noraset Pratchayakorn, a key figure in the discussions, emphasized the need for amendments to strike a balance between economic opportunity and safeguarding public health. However, he raised concerns over Section 22, which would allow alcohol sales through vending machines.

The updated Article 32 of the bill includes several new sub-articles. Article 32/1 now permits informative or educational content about alcoholic beverages. Article 32/2 prohibits celebrity promotion of alcohol consumption, except for limited academic purposes. Article 32/3 bans indirect promotion of alcohol, while Article 32/4 forbids sponsorship of public or social events that indirectly promote alcohol. Article 32/5 prohibits the publication of purely promotional content exaggerating alcohol benefits or encouraging drinking.

Under the new law, advertising is allowed if it is informative, does not appeal to minors, and does not glamourize or encourage consumption. Claims exaggerating benefits of alcohol remain banned. This represents a significant liberalization compared to the prior ban on all product or packaging displays and consumption encouragement.

The bill, consisting of 44 sections, is expected to support community-based producers and the craft beer sector by enabling legal marketing while maintaining controls against harmful promotion. The Craft Beer Trade Association (Thailand) praised the bill on its Facebook page, and Chanin Rungtanakiat, a Pheu Thai list-MP, welcomed the Senate's approval via a Facebook post.

The bill passed its second and third readings with 104 votes in favor out of 119. Ten sections of the bill, including Sections 10, 21, 22, and 32, have been flagged for potential amendments. The bill is expected to proceed for royal assent and is anticipated to come into effect later in 2025.
